The parties to this instrument are, on the one hand, SGMOBILE SERVICES, CONSULTORIA E COMÉRCIO DE PRODUTOS DE TI LTDA, a legal entity governed by private law, with its registered office at Av. Domingos de Moraes 2187 Cj 706 Torre Paris, Vila Mariana neighborhood, municipality of São Paulo /SP, CEP: 04035-000, registered with CNPJ 23.429.752/0001-78, hereinafter referred to as simply SGMobile and, on the other, the USER, a legal entity, hereinafter referred to as such.
MIENTRAS QUE:
- SG MOBILE offers USERS the option of purchasing products and services through the simfinity-mex.com application and website;
- The USER wishes to receive the products chosen by him in the form offered by SGMobile in this term.
- The parties identified and qualified above decide to enter into this agreement, which will be governed by the following clauses and conditions:
1. First clause: Application and website
1.1. When registering on the application or on the SGMobile Website, the USER will have at their disposal tools for purchasing solutions, products and services, which allow users to use, in countries with specific coverage, mobile communication services by VOICE, TEXT and DATA, interact with applications, as well as access map data, web browsing and your email account, manage your balances and consumption.

If SGMOBILE finds that among the information provided by the USER, there is incorrect, incomplete and/or untrue information, if the USER fails to send the requested documents and clarifications, or if SGMOBILE finds that there are restrictions on the economic-financial situation and/or credit of the USER, it is authorized to block the purchase of products by the USER.
2.5. The USER is responsible for the permanent updating of their registration data.
2.6. The USER, to use the services described herein, must have legal capacity for civil acts and must necessarily provide the information required in the registration, assuming full responsibility (including civil and criminal) for the accuracy and veracity of the information provided in the registration.
2.7. After validation of the registration, the USER will be released to use the APPLICATION.

3. Third clause: How the purchase works
3.1. 3.13. THE USER ACKNOWLEDGES AND AGREES THAT SGMOBILE WILL NOT BE RESPONSIBLE FOR THE CONTENT, ADVERTISING, PRODUCTS, SERVICES OR OTHER MATERIALS CONTAINED OR MADE AVAILABLE BY ADVERTISERS, THROUGH LINKS CONTAINED ON THE WEBSITE, IN THE APPLICATION OR WHERE THE SERVICE IS BEING MADE AVAILABLE.

4 . Cláusula quarta: Responsabilidade
4.1. A SGMOBILE ACONSELHA AOS USUÁRIOS QUE MANTENHAM OS SEUS ANTIVÍRUS ATUALIZADOS E UTILIZEM FIREWALL, DIMINUINDO CONSIDERAVELMENTE AS CHANCES DE TEREM SEUS DADOS INTERCEPTADOS POR PESSOAS MAL INTENCIONADAS.
4.2. Tendo em vista as características inerentes ao ambiente da Internet, a SGMobile não se responsabiliza por interrupções ou suspensões de conexão ocasionadas por caso fortuito ou de força maior, bem como por falhas, interrupções, suspensões de conexão, configurações e/ou mau funcionamento eletrônico de qualquer rede, “hardware”ou “software”, disponibilidade e acesso à internet por parte do USUÁRIO, assim como qualquer informação incorreta ou incompleta fornecida por este no seu cadastro.
4.3. O USUÁRIO declara, reconhece e aceita como de sua responsabilidade e risco de operar o sistema e utilizar os serviços. O USUÁRIO atesta que utiliza sua própria escolha livre e desimpedida para participar voluntariamente nesta atividade. O USUÁRIO se compromete a tomar o devido cuidado durante a compartilhamento, participação, uso e/ou operação dos serviços. O USUÁRIO reconhece, compreende e tem consciência de todos os riscos que se relacionam ao uso dos SERVIÇOS.
4.4. A SGMobile não se responsabilizará, em hipótese alguma, por roubo, perdas ou danos relacionados ao uso dos serviços.
4.5. A SGMobile não poderá ser responsabilizada por qualquer falha ou não funcionamento dos serviços provenientes de terceiros ou decorrentes de caso fortuito ou força maior.
4.6. O USUÁRIO isenta a SGMobile de toda responsabilidade, a qualquer título, por quaisquer danos, tais como danos materiais, pessoais, morais, estéticos, que venha a causar a si ou a terceiros, ou que venha a sofrer em razão de quaisquer eventos ocorridos ou relacionados ao uso do aplicativo ou dos serviços.
4.7. O USUÁRIO deve usar o bom senso ao usar esse Conteúdo; (b) imagens, textos e conteúdos de terceiros são fornecidos sem qualquer tipo de responsabilidade por parte da SGMobile. Caso o USUÁRIO se sinta ofendido ou infrinja direito próprio ou de terceiros, requer a SGMobile que seja imediatamente notificada, a fim de que tome as devidas providências perante os devidos responsáveis; (c) Determinado Conteúdo pode ser fornecido nos termos de licença de outras sociedades e empresas que não sejam a SGMobile, e está sujeito aos direitos autorais e a outros direitos de propriedade intelectual detidos por outros terceiros. O USUÁRIO poderá ser responsabilizado por qualquer cópia ou divulgação não autorizada do Conteúdo.
5. Clause five: Privacy of information
5.1. 6. Clause Six: Violation in the system or database

7. Clause Seven: General Provisions
7.1. This Agreement will be in force for an indefinite period of time, counting from acceptance by the USER.
7.2. At any time, either party can denounce this adjustment without reason, simply by communicating it to the other party in writing or through the customer service channels.
7.3. The USER declares that he has evaluated all the terms and conditions of this instrument, and that he accepts and agrees with all the provisions contained herein. It also recognizes that SGMobile may, at any time, request information from the USER, for any reason whatsoever.
7.4. This TERMS OF USE may, at any time, have its content, or part of it, modified for adjustments and insertions, all with a view to improving the services available.
7.5. The new conditions will come into force as soon as they are published on the website, and the USER may express opposition to any of the modified terms, as long as they do so in writing, through the SGMobile website, which will automatically cancel their REGISTRATION.
8. Eighth Clause: Forum
8.1. The parties elect the São Paulo – SP domicile forum as competent to resolve any doubts or controversies arising from this instrument.
